This is the most recent response that I received from Sodexho and Gallagher Bassett regarding the status of my FOOD POISONING claim
This is a transcription of the conversation that I had with Danielle
Morrill (the claim adjuster/case manager at Gallagher Bassett) on
Thursday, March 26, 2009 regarding a personal injury claim that I
filed on Monday, March 16, 2009.
TMR:
Good Afternoon Danielle, I am contacting you in regards to the status
of my personal injury claim. It has been almost two weeks since
my claim was submitted by Sodexho Food Company to your company
(Gallagher Bassett) but I have yet to hear back from anyone.
Danielle:
“Well I made an attempt to call you but the contact number listed
on the report was incorrect”
TMR:
“Did you attempt to call your client back to confirm the number”
Danielle:
“No. But I did mail you a letter”, “Well, since I have you on
the line would you mind giving your statement?”
TMR:
“That will be fine”
Danielle:
“Your statement will be recorded”
TMR:
“I understand”
Danielle:
“Explain to me in your word what happened”
TMR: ”On Wednesday March 4, 2009 at approximately 1:00pm, I purchased an Arden B. Lemonade from your facility. Soon after purchasing the product, I found out that it had expired 10 days earlier. Unfortunately, as a result I became ill and had to leave work early. I had been working with Mr. James Quinn to resolve this issue. On the day of the incident he assured me that he would be sending the expired product that made me sick to the lab. He also stated that I should follow up with him regarding the status of my illness. It has been a week and I have yet to receive any feedback from Mr. Quinn regarding the lab test results. After a few attempts to contact Mr. Quinn I was finally able to reach him by phone on Friday March 6, 2009 at which time he agreed to have a follow-up meeting with me Monday March 9, 2009 at 2:30 pm. During the first few minutes of the meeting Mr. Quinn informed that this issue was a issue he could not handle and that I would have to talk to upper management about it. After meeting with his manager Chris Munkel an personal injury report was made and I was funneled to your company (Gallagher Bassett) ”
Danielle:
“What did you eat that morning for breakfast”
TMR:
Fruit (2 servings of organic strawberries)
Danielle:
“What did you eat the day before?”
TMR:
“That is totally irrelevant considering I wasn’t sick prior to
the day before but, however; I did get sick after consuming the out
dated product.”
Danielle:
“I don't believe that you could have gotten sick after only having
a few ounces the product in your system”,“it was only lemonade,
how could I have gotten sick”
TMR:
“We would be able to do a better assessment of the expired product
but, after questioning the manager about the lab result, he basically
admitted that there was never any test ran and the product was
actually disposed of instead of being sent to the lab as he assured
me he would.” So the BIGGER ISSUE is that the evidence
(i.e. the expired product) was never sent for testing but was
actually disposed of which is a crime itself.
Danielle:
“Did you see a medical professional”
TMR:
“Yes”
Danielle:
“I need a copy of the test results”
TMR:
“There are no test results. The medical professional followed
standard procedure: FIND OUT THE SYMPTONS; MAKE A DIANOSIS, THEN
SUGGEST TREATMENT. Treatment doesn’t not always require
having test ran especially in the case of food poisoning. The
treatment was that “it has to run it’s course threw my system”
and that was to schedule a follow-up visit if the symptoms continued
after a certain period of time.”
Danielle:
“How can you really know if our product made you sick?”
TMR:
“As a Nutritional Advisory myself I am not only aware of how to but
I do practice proper food combing. So your trying to build a case of
what I ate the day before is null and void. Please know that I
am EXTREMELY conscious of what goes into my body. The fact is, the
company that you are representing (Sodexho, Cox Dining Hall) sold me
an expired product and I became ill is the REAL ISSUE not what I ate
before the expired product, especially considering that I was not ill
before I consumed that product. So my question to you is: What
is the next step in resolving this issue?”
Danielle:
“Well I need to contact my client and get back in contact with you
later”

On September 25th I ate a personal pizza from the Pizza Hut at Cox hall and within an hour of eating the pizza I was nauseas and vomiting. I ate a bowl of oatmeal for breakfast 4 hours earlier. After vomiting for over half an hour I felt much better but was dehydrated. The next day I was fine. I filed an incident report on the 28th with Chris Munkel, who told me that my symptoms were not indicative of food borne illness because as he put it (paraphrasing) "bacteria take time to develop inside the stomach and there are no types of food borne illness that can occur within the short time frame that you described". Obviously this is wrong, as symptoms of food borne illness can occur within 30 minutes:

I filled out a form requesting a refund and I'll be waiting to see if i get it.

A food borne illness is 2 or more people ill that is confirmed by a stool sample. YOU do not have this. Your claim is not proven.
